Definitions

In these Terms and Conditions:

"Klika" means Kmate Pty Ltd acting as The Trustee for Kmate Unit Trust (ABN 36 512 820 728), trading as Kmate or Klika.

"Purchaser", "Buyer", or "Customer" means the individual, business or entity purchasing goods from Klika.


Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

The benefits provided under this warranty are in addition to your rights and remedies under the Australian Consumer Law.


Initiating a Warranty Claim

Warranty claims are administered by Klika.

To lodge a warranty claim, please contact us by:

To assist with assessing your claim, we may request photographs, videos or other reasonable evidence of the reported defect. We may also provide instructions to assist in identifying or resolving the issue.

Where a return is required and a Return Authority (RA) has been issued, the goods must be returned within 14 days, or within another reasonable period agreed between Klika and the Purchaser.

Where a refund is approved for purchases made in currencies other than Australian Dollars (AUD), refunds will generally be processed in the original payment currency where possible. Currency exchange rate fluctuations outside our control may affect the final refunded amount. The original AUD selling price remains the reference value of the goods.


Payment of Goods

Legal ownership of the goods remains with Klika until full payment has been received for the goods supplied under this or any other agreement between Klika and the Purchaser.

Risk in the goods passes to the Purchaser upon delivery.

The Purchaser is responsible for inspecting the goods promptly upon delivery and notifying Klika of any damage, shortages or defects within a reasonable period.

While Klika will make every reasonable effort to dispatch and deliver goods within the estimated timeframes, delivery dates are estimates only. To the extent permitted by law, Klika is not liable for delays caused by events beyond its reasonable control, including delays relating to delivery, warranty assessment, repairs or refunds. Nothing in this clause excludes or limits any rights available under the Australian Consumer Law.


Delivery

Bulky Goods

Shipping charges for bulky or heavy products vary depending on the delivery postcode.

Unfortunately, door-to-door delivery cannot be guaranteed for every location. Customers in regional or remote areas may be required to collect their goods from the nearest freight depot. Please contact us before ordering if you are unsure whether this applies to your location.

If delivery cannot be completed because no one is available to accept the goods, the freight carrier may leave collection instructions or arrange collection from the nearest depot. Additional delivery charges may apply for re-delivery requests.

Estimated delivery times are generally 1–5 business days for metropolitan areas. Longer delivery times may apply to regional and remote locations.

Where delivery to your location is unavailable, you may arrange your own courier or collect your order from our Melbourne warehouse.

Unless otherwise agreed, delivery is to the building entrance only. Assistance from the recipient may be required to unload bulky items.


Next Day Dispatch

"Next Day Local Dispatch" means eligible orders will generally be dispatched within one business day of payment confirmation. This offer applies only to products physically stocked in our own warehouse. Products supplied, warehoused or fulfilled by third-party suppliers are excluded.

Next Day Local Dispatch refers to dispatch only and does not guarantee next-day delivery.

While we make every reasonable effort to dispatch eligible orders within the stated timeframe, delays may occur due to circumstances beyond our reasonable control, including courier delays, supplier issues, system outages or high order volumes. Such delays do not automatically entitle a customer to a refund or discount, unless required under the Australian Consumer Law.


Click & Collect Terms

Full payment must be received before goods can be collected.

Where payment is made by EFT or direct deposit, cleared funds must be received before collection can occur.

Click & Collect is available only for eligible products purchased through:

Collection is available during our published business hours from:

41–45 Mills Road, Braeside VIC 3195

Customers must follow the collection instructions provided via SMS or email.

Please ensure you:

  • bring suitable identification;

  • at the time of collecting the order, present the credit card to our staff which was used to process the payment for orders where payment was processed with a credit card; 

  • bring a vehicle capable of safely transporting your purchase; and

  • arrange assistance if required, as our staff are unable to assist with loading goods into customer vehicles.

Our staff will place the goods adjacent to your vehicle and confirm your order details before releasing the goods.

Customers should inspect all items carefully before leaving the collection point. Once goods have been collected, responsibility for the goods passes to the customer in accordance with these Terms and Conditions.

Where operational health and safety procedures apply, customers must comply with all reasonable directions provided by our staff.

Klika reserves the right to modify, suspend or withdraw the Click & Collect service at any time where reasonably necessary.


Pricing and Product Availability

All prices, product availability and promotional offers are subject to change without notice.

We reserve the right to amend pricing, discontinue products, update specifications or withdraw products where necessary due to circumstances including, but not limited to:

  • supplier price changes;

  • product discontinuation;

  • stock shortages;

  • market conditions;

  • technical errors; or

  • publishing errors.

All orders remain subject to product availability.

While we take reasonable care to ensure information published in our catalogues, promotional material and websites is accurate, occasional typographical or technical errors may occur.

Except where required under the Australian Consumer Law, all information is provided on an "as is" basis without additional warranties regarding completeness or accuracy.


Products on Presale

Products advertised as "On Presale" are offered for purchase before they become available for dispatch.

By placing a presale order, you acknowledge that:

  • you are entering into a binding contract for the purchase of the goods;

  • the advertised dispatch date is an estimate only; and

  • dispatch dates may change due to manufacturing, shipping or other operational factors outside our reasonable control.

If the anticipated dispatch date changes materially, we will endeavour to notify affected customers as soon as reasonably practicable.

Where products become available earlier than anticipated, we may dispatch them without prior notice.

Nothing in this section limits or excludes any rights or remedies available to consumers under the Australian Consumer Law, including rights relating to significant delays or non-supply where applicable.


30-Day Money Back Return Policy

At Klika, we stand behind the quality of our products. For selected products, we offer a 30-Day Money Back Return Policy for eligible change-of-mind purchases.

Only products specifically advertised on klika.com.au as eligible for a 30-Day Change of Mind Return qualify under this policy. This policy applies only to purchases made directly through Klika.com.au and does not apply to purchases made through third-party retailers or marketplaces.

All returns remain subject to these Terms and Conditions.

If your product is eligible, you may contact us within 30 days of the invoice date to arrange a return and receive either:

  • a refund of the purchase price; or

  • a store credit,

excluding the original delivery charge. Where an item was supplied with "Free Delivery", the actual delivery cost incurred by Klika may be deducted from the refund or store credit.

Products that are not specifically advertised as eligible under this policy are not eligible for change-of-mind returns.

Conditions of Return

To qualify under this policy, the product must:

  • be returned in its original, unopened and undamaged packaging;

  • include all accessories, manuals and included components;

  • be in new, unused and resaleable condition; and

  • not have been assembled, installed, used or damaged while in the customer's possession.

To request a return, you must contact Klika by phone or email within 30 days of the invoice date and follow the return instructions provided by our team.

Once approved, the product must be returned within 14 days.

Unless otherwise required under the Australian Consumer Law, customers are responsible for the cost of returning change-of-mind items and remain responsible for the goods until they are received by Klika.

After receiving the returned product, we will inspect it and, if approved, process your refund or store credit as soon as reasonably practicable. An email confirmation will be provided once processing has been completed.

If the returned product does not meet the requirements of this policy, Klika may decline the return. In this case, the customer will be responsible for the cost of return shipping or collection within seven (7) days of notification.

Klika may amend or withdraw this Change of Mind Policy from time to time, provided that any changes will not affect returns already approved under this policy.

Nothing in this policy limits, excludes or replaces any rights or remedies available under the Australian Consumer Law.


Warranty

Minor and Major Faults

Subject to the Australian Consumer Law, Klika warrants that products supplied will be free from defects in materials and workmanship for a reasonable period, taking into account the nature, price and intended purpose of the product.

Unless a longer period is reasonably expected under the Australian Consumer Law or is expressly stated in the product listing, warranty coverage generally applies for:

  • Domestic use – up to 12 months from the date of purchase; and

  • Commercial use – up to 90 calendar days from the date of purchase.

This manufacturer's warranty is separate from, and in addition to, your rights under the Australian Consumer Law.

This warranty does not cover normal wear and tear, consumable components or minor accessories, including but not limited to:

  • chainsaw chains and guide bars;

  • pull starters;

  • cutting blades and cutting discs;

  • instrument strings;

  • storage bags and cases;

  • carry straps; and

  • other consumable accessories supplied with the product.

Where requested, products or photographs of the alleged fault must be provided to enable assessment of the warranty claim.

Warranty claims may be declined where damage has resulted from:

  • misuse or abuse;

  • accidental damage;

  • improper storage;

  • incorrect installation or assembly;

  • failure to perform recommended maintenance;

  • use contrary to operating instructions;

  • unauthorised repairs or modifications;

  • opening packaging with knives or blades causing damage;

  • neglect; or

  • any cause unrelated to a manufacturing defect.

Additional product-specific warranty exclusions are outlined later in these Terms and Conditions.


Warranty Exclusions

Examples of issues not covered by warranty include, but are not limited to:

  • misuse or operation contrary to the instruction manual;

  • use for purposes other than those advertised;

  • inadequate cleaning, lubrication or maintenance;

  • improper storage;

  • weather damage where the product is not designed for permanent outdoor exposure;

  • incorrect fuel or oil mixtures;

  • inability to operate equipment due to incorrect starting procedures or tuning;

  • storm or wind damage resulting from improper installation or inadequate securing;

  • incorrect assembly;

  • accidental damage during installation or adjustment;

  • unauthorised modifications or repairs;

  • scratches, cuts or cosmetic damage caused during unpacking;

  • consumable diaphragms used in pool cleaners;

  • products sold as ex-demonstration or used products (unless otherwise stated);

  • personal comfort preferences relating to mattresses, sofas, beds or furniture; and

  • normal body impressions of less than 52 mm in mattresses or seating, which are considered normal wear and tear.


Items Not Covered by Warranty

The following accessories are generally regarded as consumable items and are not covered by warranty unless required by the Australian Consumer Law:

  • carry bags;

  • storage bags;

  • carry straps;

  • chainsaw guide bars;

  • chainsaw chains;

  • cutting wheels;

  • cutting discs;

  • instrument strings;

  • complimentary gifts;

  • Consumable parts; 

  • Batteries;

  • promotional bonus items.


Warranty Conditions

To make a valid warranty claim:

  • the defect must be reported within a reasonable time after it is discovered;

  • the product must not continue to be used once the defect becomes apparent where further use could worsen the damage;

  • claims must be made during the applicable warranty period;

  • the warranty applies only to the original purchaser and is not transferable;

  • Klika may require photographs, videos or return of the affected product or components for assessment.

Where a warranty claim is accepted, Klika will cover the reasonable cost of returning repaired or replacement products to the customer.

Nothing in this warranty limits or excludes your rights under the Australian Consumer Law.

Where permitted by law and agreed with the Purchaser, Klika may offer a repair, replacement, partial refund or full refund as an appropriate remedy.

Unless otherwise stated, this warranty does not apply to ex-demonstration or used products.


Damaged on Arrival (DOA) Warranty Claims

This provision supplements the standard warranty for product failures and applies to goods that:

  • arrive damaged during transit;

  • have missing parts;

  • are delivered incomplete; or

  • contain manufacturing defects identified upon delivery.

Claims under this provision must be made within a reasonable period after delivery (generally within 7 calendar days).

To lodge a DOA claim, the Purchaser must notify Klika by email or in writing as soon as reasonably practicable after discovering the issue.

This warranty does not cover cosmetic damage, including cuts or scratches caused by opening the packaging with knives, blades or other sharp objects.

Unless otherwise stated in the product listing, this provision does not apply to ex-demonstration or used products.


Returning Goods for Warranty Assessment

Where required to assess or remedy a warranty claim, Klika may request that the goods or relevant parts be returned for inspection.

No refund, replacement or repair will be approved until the returned goods or components have been received and assessed, unless otherwise required under the Australian Consumer Law.

Where a return is authorised:

  • the goods must be returned using the freight method approved by Klika;

  • products should, where reasonably possible, be disassembled and repacked in a manner suitable for safe transport;

  • a valid Return Authority (RA) number must accompany all authorised returns; and

  • returned goods should be dispatched as soon as reasonably practicable after the RA has been issued.

Where reasonably practical, customers are responsible for arranging the initial return shipment using the freight method approved by Klika.

If, following assessment, Klika confirms that the product is faulty and covered by warranty, reasonable return freight costs will be reimbursed.

If inspection determines that:

  • no fault exists;

  • the reported fault cannot be reproduced;

  • the damage resulted from misuse, neglect or accidental damage; or

  • the fault is outside the scope of the warranty,

the Purchaser may be responsible for:

  • reasonable freight costs incurred in returning the goods;

  • reasonable inspection costs of $60.00 per hour, calculated on a pro-rata basis; and

  • any applicable return freight charges.

For products that are too large or heavy to be reasonably returned by the Purchaser, Klika may arrange collection where appropriate. If inspection confirms that the product is not faulty or is not covered under warranty, the Purchaser may be required to reimburse the reasonable transport and inspection costs incurred.

Klika aims to assess warranty returns as promptly as possible and may require up to 14 calendar days after receiving the returned goods to complete inspection, repair or assessment before determining the appropriate remedy.

Nothing in this section limits any rights or remedies available under the Australian Consumer Law.


Force Majeure

Klika will not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to:

  • fire;

  • flood;

  • storm;

  • natural disasters;

  • pandemic or public health emergencies;

  • technical failures;

  • equipment breakdown;

  • industrial disputes;

  • transport interruptions;

  • shortages of materials or supplies;

  • government action; or

  • any other event beyond Klika's reasonable control.

Where a Force Majeure event occurs, Klika may suspend, vary or cancel affected orders or contractual obligations to the extent reasonably necessary.

Nothing in this clause limits any rights available to consumers under the Australian Consumer Law.


Australian Consumer Rights

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantees, rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

Where any provision of these Terms is inconsistent with the Australian Consumer Law, the Australian Consumer Law will prevail to the extent of the inconsistency.

Product-Specific Warranty Exclusions

Unless otherwise required under the Australian Consumer Law, the following product-specific exclusions apply.

Trampolines and Trampoline Accessories

The warranty does not cover:

  • tears or rips in safety nets caused by misuse, accidental damage or normal wear;

  • normal wear and tear of pole protectors;

  • rust developing on the trampoline and its accessories; 

  • fading of the surfaces; 

  • deterioration from UV exposure; 

  • normal wear and tear.

Fuel-Powered Equipment

The warranty does not cover failures resulting from:

  • incorrect fuel or oil mixtures;

  • improper starting procedures;

  • incorrect carburettor tuning;

  • blocked or dirty air filters;

  • fuel left in the tank during long-term storage;

  • inadequate cleaning, servicing or maintenance.

Pool Covers

The warranty does not cover UV deterioration, including:

  • drying;

  • cracking;

  • hardening;

  • deterioration of insulation bubbles.

Such deterioration commonly results from incorrect installation, improper storage or excessive heat exposure.

Pool covers should:

  • float flat on the water with the bubble side facing downward;

  • not contain trapped air pockets that expose sections of the cover to excessive sunlight; and

  • be rolled (not folded) and stored away from direct sunlight and excessive heat when not in use. 

Gazebos, Tents, Trampolines and Garden Umbrellas

Outdoor products must always be securely anchored in accordance with the supplied instructions.

The warranty does not cover damage resulting from:

  • inadequate anchoring;

  • use during severe weather or high winds;

  • misuse;

  • incorrect assembly or installation;

  • accidental or intentional damage; or

  • products being lifted, blown over or otherwise damaged by wind.

Klika is not responsible for injury, property damage or consequential loss arising from products that have not been installed or secured in accordance with the manufacturer's instructions. 

Shade Sails

The warranty does not cover:

  • damage caused by improper installation or insufficient tensioning;

  • misuse;

  • abrasion caused by trees, branches or surrounding objects;

  • rot or mildew resulting from leaves or organic matter being left on the sail; or

  • damage caused by overtightening.


Factory Refurbished Products

Where a product is advertised as Factory Refurbished, it has been professionally restored to working order by an authorised third-party refurbishment provider.

Factory Refurbished products have been inspected, tested, cleaned and, where necessary, repaired to meet the applicable product standards.

Unless otherwise stated in the product listing:

  • the product may not be supplied in its original packaging;

  • the product may show minor cosmetic blemishes or signs of previous use that do not affect functionality; and

  • only the accessories, software and documentation specifically listed in the product description are included.

Customers should rely only on the information provided in the relevant product listing when determining what is included with a Factory Refurbished product.


Advertising and Website Errors

Klika makes every reasonable effort to ensure that product descriptions, specifications, pricing, availability and shipping information published on our website are accurate.

Despite these efforts, errors or omissions may occasionally occur.

Where a genuine pricing, product description, availability or shipping error has occurred, Klika reserves the right to cancel an order prior to dispatch and provide a full refund of any amount paid.

Any such cancellation will be communicated to the customer as soon as reasonably practicable.

Nothing in this clause limits any rights available to consumers under the Australian Consumer Law.

Product photographs are provided for illustrative purposes only.

Actual colours, finishes and product appearance may vary due to manufacturing variations, lighting conditions and individual display settings. Such variations alone do not constitute a product fault.


Governing Law

These Terms and Conditions are governed by the laws of the State of Victoria, Australia.

The parties submit to the non-exclusive jurisdiction of the courts and tribunals of Victoria.

Payment transactions are processed through secure third-party payment providers.

Klika does not store full credit card numbers or payment security codes on its own systems. We may retain limited transaction details supplied by payment providers, such as the cardholder's name and the last four digits of the payment card, for transaction verification purposes.

Although we take reasonable precautions, no method of electronic transmission or storage is completely secure. Accordingly, we cannot guarantee absolute security.

WARRANTY AND TERMS

In these conditions:
"The Company" means The Trustee for Kmate Unit Trust, trading as:
Kmate, Klika, Powertrain, Royal Manchester ABN: 36 512 820 728
"The purchaser", “buyer”, or ‘customer’ means the person, firm or company ordering or buying goods from The Company.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Initiating a warranty claim

Warranty is offered by The Company and can be contacted for the purpose lodging a warranty claim at warranty@klika.com.au, by visiting our KLIKA SUPPORT PORTAL or telephoning 03 9790 0055 during business hours. The benefit of the warranty is in addition to the guarantees provided under the Australian Consumer Law.

Action to remedy the problem may include instruction on proper use. The Company may require pictures of the defect which must be supplied. When accepted, Consumer must return the goods within 14 days of the RA being issued (or a reasonable period of time agreed to by the company and The purchaser). Purchases completed in currencies other than AUD will be converted to AUD at the time of refund. The AUD price at the time of purchase is considered the original value of the goods regardless of the currency used as payment. Refunds may be issued in AUD or the original currency if required, and will be calculated at the currency conversion rate at the time of refund.

Payment of Goods

The company and The purchaser expressly agree that until the company has been paid in full for the goods comprised on this or any other sales contracted between them full legal title remains with the company. Notwithstanding the preceding condition all risk in respect of the goods shall be assumed by the buyer upon delivery. The buyer shall examine the goods immediately the goods are delivered. Whilst the company will use its best endeavours to deliver the goods in accordance with the buyers requirements, the company will not be liable for any consequence of late delivery however caused, either with the original purchase and delivery of the item, or any subsequent delays in having the item repaired and returned, or issuing any refund.

Delivery

Bulky Goods:
The cost of shipping bulky/heavy products depends on the destination postcode. Unfortunately we cannot guarantee door to door delivery for every area for this item. Deliveries to rural areas and towns may require the goods to be collected from the nearest freight depot. (Please contact us for further details if you live in a regional location.) If for any reason you are not able to accept your goods on the day of delivery, a contact card will be left for you to call the nearest freight depot for collection. (Requesting redelivery will incur extra charges.) Delivery usually takes between 1 and 5 days although longer delays can be expected for locations outside major metro areas. In cases where we cannot to deliver this item to your location you are welcome to arrange your own courier or collect the goods in person from our Melbourne warehouse. Drivers will deliver to the entrance to the building only and customer's assistance may be required in unloading the item once delivery to destination is made.

Next Day Dispatch:
"Next Day Local Dispatch" refers to us sending out your order within 24 business hours of its receipt by us and applies to products which we physically hold at our own warehouse. Products sourced, warehoused or delivered by our partner suppliers are excluded. We note that this not a representation of a next day delivery to the consumer, nor an absolute representation as there will be events outside of our control, resulting in delays in dispatch of your order and will not warrant a refund or a discount to be applied to your payment.

Products on Presale:

Where Goods are advertised to be 'On Presale' the Buyers acknowledge that they are entering into a contract of sale with an anticipated future dispatch date for the Goods they have purchased.
The dispatch date stated in the advertisement is an approximate date and we reserve the right to change this date at our discretion. If the date is changed to a date which is materially later than the previously advertised date, where possible, we will endeavor to inform the customers who had purchased this product with an earlier anticipated date of dispatch. In the event we are able to dispatch the Goods earlier than the date noted in our advertisements, we will do so without further notice to the customers.
By purchasing the Goods on presale Buyers accept all terms governing the use of this site and acknowledge that they have entered into a legally binding contract of sale and will not be granted a right to terminate the purchase.

30 Day Money Back Return Policy

At Klika we stand behind our products! That is why we offer a 30 Day Money Back Policy for select products.
Only the products which are explicitly advertised in their product listings as qualifying for a 30 day change of mind return, purchased at Klika.com.au (and not any other reseller or platform) are able to be returned for change of mind purposes under this policy. All returns are subject to the Klika Terms and Conditions
You can contact us within 30 days of the date noted on your invoice and organise to return the Product and receive either a store credit or refund of the purchase price of Your Product (excluding initial delivery charges and less a delivery expense we incurred if the item was advertised as "free delivery", to be confirmed by Klika prior to the refund or store credit being processed).
Whilst change of mind returns are available for specific products, for all other products, change of mind returns are not permitted.
To qualify to return an item under this Policy, Products must be in original unopened and unmarked packaging, along with all included accessories and manuals, be in new pristine condition suitable for resale, and must not be damaged or used in any way by the customer during the time the item is in the customer's possession.
In order to organise a return under the 30 Day Money Back Return Policy You must notify Klika via email or phone within 30 days of the date noted on the invoice of Your Product and request a return under this Policy. You must comply with the directions of Klika’s staff in order for the return to be effected.
  • The Product must be returned to Klika within 10 calendar days of Your request to return Your Product under this Policy being approved by Klika.
  • You must return the Products for which You are seeking a store credit or refund at Your own cost and You must comply with the directions for returning the Product that Klika staff provide to You. You will remain responsible for the goods until such time as they are received at the address supplied by Klika’s staff. Klika will accept no liability for any loss or damage which may occur during transit.
  • After receiving the returned Product, Klika will as soon as practicable assess the returned product and issue a store credit or refund as soon and You will be provided with an e-mail acknowledgement of same.
  • Should Your Product be returned in a condition which Klika’s staff deem to be in breach of the 30 Day Money Back Guarantee Policy, You will be required to pay the shipping costs for its return to you or arrange collection within 7 days of being notified of Klika’s staff’s determination.
  • Klika reserves the right to make changes to this Returns Policy without notice or delete it its entirety at its sole discretion.
Our Returns Policy includes, and does not seek to exclude or limit, the rights you have under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. The warranties and product support that we offer and provide pursuant to our Terms and Conditions are in addition to the consumer warranties and guarantees under the Australian Consumer Law.

Minor and major faults, short or long-term failure:

The Company guarantees to the purchaser that the goods will be free from defects caused by faulty materials or poor workmanship for a reasonable period of time based on the product's value and intended purpose(i.e, generally no longer than 12 months from the date of purchase for domestic use, unless it is reasonably expected to be a longer period of time) and for a period no longer than 90 calendar days from the date of purchase for commercial use unless otherwise stated in the listing or advertisement at the time of purchase. This warranty does not cover minor accessories or attachments or consumable parts, including but not limited to, chainsaw chains, pull starts, cutting blades or discs, instrument strings, product bags and cases, and carry straps etc. Examination by the company of such goods (or photos of the faulty goods if requested) shall disclose to its satisfaction that such defects exist and have not been caused by misuse, neglect, accident, improper storage, installation or handling, other incorrect or lack of proper maintenance, opening cartons with blades, or by repair or alteration not affected by the company. Further item specific failures for products such as fuel powered products, trampolines, outdoor structures (gazebos, tents, and umbrellas), bedding, and pool covers are detailed later in this document.

Defects and failures not covered by warranty include, but are not limited to:

  • Damage due to user misuse or use in a manner contrary to the operating instructions
  • Damage resulting from the item being used in a manner other than originally intended as advertised
  • Improper or neglected maintenance including oiling and cleaning where required
  • Improper storage or neglect to properly prepare the item for storage
  • Exposing products to the elements where the product advertisement does not specifically state that the product is weatherised or can be left outdoors (i.e., power tools, camping products, jockey wheels, trailer accessories).
  • Incorrect fuel or oil use, including 2-stroke fuel mixture where applicable
  • The user’s inability to properly use the item, including starting or tuning of engines
  • Storm or wind damage to items which have not been correctly installed or adequately secured
  • Failure due to improper user installation or assembly
  • Damage cause when assembling, tuning, or adjusting the product
  • Dismantling or modifications carried out to the product without obtaining prior written approval from us.
  • Cuts and scratches etc such as those caused by opening packaging with blades or knives
  • Diaphragms used in pool cleaners which are regarded as consumable accessories.
  • Items sold as ex-demo, or used unless otherwise stated in the advertisement at time of sale
  • Comfort choice issues relating to mattresses, beds, couches and furniture (i.e., too firm or too soft) will not give rise to a warranty claim as comfort is a subjective notion and will not be considered a manufacturing fault.
  • Body impression on mattresses, sofas and chairs where the indentation is less than 52mm and moderate sagging over time is considered normal wear and tear, and does not give rise to a warranty claim.

Items, parts, and accessories not covered by warranty include, but are not limited to:

  • Carry and storage bags and straps supplied as an accessory to the main product
  • Chainsaw bars and chains
  • Cutting wheels and discs
  • Instrument strings and minor accessories
  • Free gift or bonus items supplied with the main product

Conditions for warranty under short-term or long-term failure:

  • Warranty claims must be made within a reasonable period of time of the defect being discovered
  • The product must not be used after any problem or defect is detected, failing which, all guarantees and warranties applicable to that product or part will be rendered void.
  • Warranty claims are limited to the original warranty period from the date of purchase
  • All warranties only apply to the original purchaser, and are not transferable
  • The Company may require pictures of, or return of the faulty/damaged item(s) or parts
  • Re-delivery of the repaired item or replacement parts will be at the cost of The Company where the warranty claim is found to be a legitimate claim under the terms of this warranty
  • The Australian Consumer Law provides certain guarantees to consumers when they purchase goods and these guarantees cannot be excluded, restricted or modified. These consumer guarantees are different to, and separate from, this warranty, which is given voluntarily by the Warrantor. The time limit of consumer guarantees varies depending on the price and quality of the goods and may extend beyond this warranty or any applicable warranty provided by the manufacturer of the goods.
  • On occasion The Company may supply a full or partial refund as compensation for item damage, failure, or restricted function, subject to this being permitted under Australian Consumer Law, and agreed to between The Company and the Purchaser.
  • Unless otherwise stated in the advertisement this warranty does not apply to items sold as ex-demo, or used.

DOA: Faulty or damaged on arrival warranty claims:

This provision is an extension of the regular warranty condition for ‘Product Failure’ as described above and covers items damaged in transit, missing parts, partial delivery, or items having existing defects on delivery.
  • Claims under this provision will only be accepted within reasonable period of time from the date of delivery (usually 7 calendar days)
  • The buyer must inform The Company by email or in writing within the reasonable period after delivery of the item being received in a damaged on arrival state.
  • Cuts and scratches to the product caused by opening cartons with blades etc are not covered under warranty
  • Unless otherwise stated in the advertisement this clause does not apply to items sold as ex-demo, or used

Returning items where requested by The Company:

  • When required by The Company, goods may need to be returned to The Company to effect the warranty.
  • No refunds or replacements will be issued prior to the returned goods or parts being received by The Company
  • Goods must be returned using the freight method agreed to by The Company and the Customer which will be determined according to the product and product location. Items must be disassembled and packed to their original delivery state
  • Return freight costs will not apply to goods found to be in working order or where the fault is other than originally described by the customer in the course of making the original warranty claim
  • Items must be authorised for return by The Company prior to the goods being returned. The Company will issue the customer a ‘Return Authority’ number (RA) which must be included with the returned item
  • All returned goods must arrive back with The Company as soon as reasonably possible from the date the RA was issued
  • In cases where the goods or parts must be returned to The Company for assessment and these goods or parts can be easily returned, Purchaser is to arrange return of goods using The Company’s approved freight delivery method at the purchaser’s expense and The company will reimburse the Purchaser reasonable return postage costs if the Company confirms that the product or part returned is faulty.
  • If no fault is found, or products or parts exhibit signs of physical damage, or neglect, the Purchaser will be responsible for reimbursing The Company the shipping costs to and from the Purchaser, and inspections costs equating to $60.00 per hour, on a pro rata basis, relating to the time spent inspecting and checking the product or part returned.
  • If a product is too large or too heavy and the Purchaser did not pick up the product from the Company’s premises, The Company will arrange for it to be returned to the Company at its expense, for inspection, within a reasonable period of time after being informed that a fault exists. Should no fault be found with the returned item or part, the Purchaser will be required to reimburse the company all shipping costs to and from the Purchaser, and inspections costs equating to $60.00 per hour, on a pro rata basis, relating to the time spent inspecting and checking the product or part returned.
  • The Company may require up to 14 days after receiving the returned item to asses and/or repair the problem prior to initiating any return or refund

Force Majeure

The company reserves the right to cancel, vary or suspend the operation or contract of sales if events occur which are in the nature of force majeure including (and without prejudice to the generality of the foregoing) fire, floods, storm, technical failure, plant breakdown, strikes, lock-outs, riots, hostilities, non-availability of materials or supplies or any other event outside the control of the company and the the company shall not be held liable for any breach of contract resulting from such event.

Australian Consumer Rights

Consumer guarantees apply under the Australian Consumer Law. Nothing in these Terms and Conditions excludes the application of those guarantees. For more information about your rights as a consumer, see the Australian Consumer Law website at http://www.consumerlaw.gov.au.

Additional item-specific warranty disclaimers:

The Company will not cover specific warranty claims on products including, but not limited to, the following (unless required under the Australian Consumer Law):

TRAMPOLINES AND TRAMPOLINE ACCESSORIES:

  • Rips and tears in nets
  • General wear and tear to pole protectors
  • General wear and tear to Jump-Mat

FUEL POWERED EQUIPMENT:

  • Damage caused by incorrect fuel use
  • Inability to start due to incorrect tuning, starting procedure, or dirty filters
  • Product which has been stored for long periods with fuel in the tank
  • Product not maintained, oiled, and cleaned

POOL COVERS:

UV damage to pool covers (dried, cracked, hardened areas, broken insulation bubbles) will not be covered under warranty. Such damage is caused by improper installation or storage of the cover. Pool covers should lay flat on the water surface with the bubble side down. Folds in the cover or large air bubbles under the cover which prevent the cover from laying flat on the water cause the cover to overheat in sunlight which can cause the cover to become brittle over time. When the cover is stored off the pool it must be stored rolled, not folded, and be kept out of sunlight and excessive heat until it is installed back onto the pool surface.

GAZEBOS, TENTS, TRAMPOLINES and GARDEN UMBRELLAS:

Outdoor items including gazebos, tents, and umbrellas must be securely tied down. The Company will not be liable for damage to items ‘blown away’ by the wind or damage to persons or property caused by the item which was not sufficiently secured against weather. The warranty policy does not cover:
  • Damage caused by product not being secured properly as required
  • Physical damage caused by use during inclement weather
  • Physical damage caused by misuse of the product
  • Physical damage caused by incorrect erection of the product
  • Physical damage caused accidentally or purposefully
  • Physical damage caused by the item blowing away under windy conditions

SHADE SAILS

Klika will not cover specific warranty claims on shade sails including, but not limited to, the following:
  • Damage caused by the product not being secured properly as required
  • Damage caused by misuse of the product
  • Damage caused by wear and tear from trees and branches etc
  • Damage from rot or mildew resulting from leaves etc being left on the sail
  • Damage caused by overtightening

FACTORY REFURBISHED

Where our listing notes that a product offered for sale is a Factory Refurbished item, it means that this product has been professionally restored to working order by a third party vendor. This product has been inspected, cleaned, and repaired to meet product classifications. This item may or may not be in its original packaging and may or may not exhibit signs of prior use, and cosmetic blemishes. It will be supplied with accessories and software specifically mentioned in our listing and not any other external guide or website.

Advertising and website errors:

The company takes all care to ensure products, features, and prices of current stock displayed are correct at all times. The company reserves the right to cancel and refund any purchase in full prior to dispatch for any reason including, but not limited to, errors in product description, advertised product price, or quoted shipping costs. In such cases the transaction may be cancelled and the full price paid will be refunded. Any such errors are unintentional. All photographs of products are used for illustration purposes only. The colour and shade of product may vary due to manufacturing runs and users' screen resolutions and does not give rise to claims for refunds of replacements.

All pricing is subject to change. We reserve the right to make adjustments to pricing, products and service offerings for reasons including, but not limited to, changing market conditions, product discontinuation, product unavailability, manufacturer price changes and errors in advertisements. Terms for Contactless Click and Collect Offer:

  • Full payment is required to be processed prior to collection of goods. If payment is being processed by EFT or direct deposit to our bank account, clear funds must be received in our bank account prior to collection of goods.

  • Collection is available from 41-45 Mills Road, Braeside Victoria, during our standard operating hours.

  • Ensure you bring an appropriate vehicle to fit the goods purchased and that you bring support to assist you to load the goods to your vehicle, as our staff are not permitted to assist in the loading process.
  • Our staff will place the goods next to your vehicle and confirm your purchase details whilst maintaining social distancing. Once details have been confirmed the product will be released into your possession. Please inspect the goods thoroughly as we will not accept claims of damage in transit once you have taken possession of the goods.
  • Do not leave the vehicle until such time as our staff leave the vicinity.
  • At all times, you are required to maintain social distancing with our staff and customers.
  • We reserve the right to vary these terms and conditions at any time. We urge you to review these terms regularly.
  • We reserve the right to suspend the click and collect services at any time, without notice.

1. Definitions 

For this Promotion, the following terms have the following meanings: 

  • AEDT -  Australian Eastern Daylight Time.

  • Immediate Family  - Any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin

  • Promotion - "Kahuna Photo/Video Competition - January 2022 "

  • Promotion Period – 12.00pm AEDT on 31st January 2022 – 12.00pm AEDT on 13th February 2022. 

2. Eligibility 

Australian residents aged 18 years or over are eligible to enter this Promotion.  Employees of the Promoter (or any related entity of the Promoter) and their Immediate Family are not eligible to enter this Promotion. Persons under the age of 18 may enter only with the consent of their parent or legal guardian.  If such consent is not given, their entry will be deemed invalid, and any prize forfeited for a redraw. 

3. Entry 

  • By entering this Promotion, the entrant accepts these terms and conditions.  

  • The number of entries a person may submit is not limited provided each entry is different. 

  • To enter, entrants must during the Promotion Period:

    • Post a photo or video depicting a Kahuna trampoline  in the possession of the entrant on Facebook or Instagram with the hashtag #kahunaplay

  • Promoter retains the right to remove entries it deems to be inappropriate or offensive without any notice to the entrant.

  • This competition is being conducted on Facebook and Instagram with their own technical requirements, terms and conditions and fair usage policies. The Promoter accepts no responsibility if an entrant fails to follow the applicable requirements.

  • By entering the competition, each entrant releases Facebook and Instagram from all liability in relation to the competition and acknowledges that this competition is in no way sponsored, endorsed or administered by, or associated with Facebook and Instagram and that any information provided by entrants is provided to the Promoter and not to Facebook or Instagram. 

  • By entering the competition, each entrant acknowledges that their name and entry content may be used for printing, broadcast, publicity, promotional and marketing purposes, including but not limited to the Promoter’s websites and social media accounts without compensation. It is a condition of accepting the prize, and as consideration for that prize, that each prize winner assigns all right, title and interest in their entry and any photo and/or written description of the prize being taken to the Promoter to enable the use of it by the Promoter, including for commercial purposes and they agree not to object to any such use on the basis of any moral right. A prize winner will, if required by the Promoter, complete any documentation necessary to give effect to this assignment of right, title and interest. 

4. Prizes

  • There will be one (1) prize and one (1) winner. 

  • The prize will consist of a single unit of a voucher to shop on klika.com.au to the value of $250.00.

  • Voucher is to be used in a single transaction and will expire 12 months from the date of issue. 

  • Prize is not transferable and cannot be exchanged for cash.. 

5. Draw

  • This competition is a game of skill and chance plays no part in determining the winners. All valid entries received during the Promotion Period will be judged on their merit and the entrant who submitted the entry judged to be the most inventive and creative received will win the prizes. 

  • The winner of the prize will be judged by the Promoter by 5PM AEDT 14th February 2022. This will take place in the Promoter's office in Braeside, Victoria or at another location deemed appropriate by the Promoter. 

6. Winners  

  • Winner of the prize will be announced on the Promoter’s Facebook and Instagram social media accounts and/or website (www.klika.com.au) at 12PM AEDT on 15th February 2022.  

  • Winner will be notified within 48 hours of judging being finalised via their social media, email address or phone number, used to enter the Promotion. 

  • The winner of the prize must sign any release form that may be required by the Promoter.  

  • The prize must be claimed by the winner within 14 days of the Promoter announcing the competition results. In the event that a winner fails to claim their prize by responding to the Promoter’s announcement and/or contact,, the prize will be forfeited and the eligible entrant who submitted the entry judged to be the next best received in the Promotion Period will be offered the prize.

  • If a prize is forfeited, a new winner will be announced within 48 hours of the prize forfeit, and contacted via their social media account, email address or phone number used to enter the Promotion. 

7. Promoter's Rights

  • The Promoter may verify the validity of entries and entrants (including an entrant's identity, age and place of residence).  

  • The Promoter may disqualify an entrant who submits an entry that is not in accordance with these terms and conditions, who tampers with the entry process or who uses automated entry software or other mechanical or electronic means that allows a person to automatically enter repeatedly.  The Promoter may either disqualify an entrant or modify, suspend, terminate or cancel this Promotion if this Promotion is interfered with or this Promotion is not capable of being conducted as reasonably expected due to a reason beyond the control of the Promoter, including technical difficulties, unauthorised intervention or fraud, subject to any written directions from a regulatory authority. 

  • If for any reason this competition is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the competition, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the competition. 

8. Promoter’s liability 

  • The Promoter is not liable for any loss, expense, damage or liability that may be suffered or incurred by a person in entering this Promotion or accepting and using the prizes.  

  • If the Promoter is liable, the Promoter’s liability is limited to either resupply of the goods or services.  This section does not alter a person’s rights under the Australian Consumer Law,
